Abstract

The subject of this article is historical and modern approaches to determining the civil status of a state, as well as the analysis of foreign approaches to resolving a similar situation. Exploring the main scientific views on the legal personality of the state in modern science, the author defends the scientific view that the most acceptable for the Civil Law of the Russian Federation is a three-part division of Civil Law subjects, in the line of which the state occupies a special place along with individuals and legal entities. Arguing a point of view that "legal registration" features of the state as a subject of Civil Law relations can and should be done at the level of the already pre-installed legislator positions, the author comes to a conclusion: to solve a scientific problem fixing status of the state as a participant of civil relations is necessary at the level of varieties of subjects, and not at the level of varieties of juridical persons, excluding for this purpose quite common in the doctrine of the design of public legal entity.
