Abstract

The article analyzes the concept of "foreign element" in the framework of legal relations that constitute the subject of private international law. Its use in the national doctrine and the doc-trine of common law countries, in the legislation of the Russian Federation and other CIS countries is consistently considered. The author substantiates the conclusion that the concept of "foreign ele-ment" has a conditional (at least – illustrative) character, since from a theoretical point of view it is characterized by a mismatch terminology of theory, and from the point of view of legal technique - a discrepancy of its content in various normative legal acts of the Russian Federation (Civil Code of the Russian Federation and Code of commercial navigation of the Russian Federation). The author defends the expediency of allocating the category "foreign element with conflict-of-law signifi-cance" on the grounds that in the conditions of the variety of international relations of individuals and the impossibility of their positive definition, a foreign element acquires legal significance only if it is relevant from the position of binding the conflict-of-law norm of a certain lex fori.
