Abstract

The purpose of the article is to analyze the interconnection of the concepts of “passive suffrage (the right to be elected)”, “electoral process”, “nomination and registration of candidates”, “legitimacy of authority” in terms of their reflection in the legislation of the Russian Federation. The authors make a review of the main changes in the legal regulation of the nomination and registration of candidates for different types of elections and their impact on the legitimacy of authority. The article examines in detail the content characteristics of the rights and interests of voters, candidates in the process of implementing passive suffrage, its borders and their impact on the degree of people's credibility of the government. The study tests the main scientific approaches to these phenomena, including the essence of the restrictions of passive suffrage. Moreover, the research contains examples from the practice of the constitutional Court of the Russian Federation and the European Court of human rights. The main conclusion of the article is that the principle of alternatives of elections has been implemented in the Russian electoral legislation, as well as the conditions for the further development of political competition and more effective implementation of the right to be elected.
