Abstract

Shows the process of formation of the international legal regime of the Arctic, the role of the customary rules of International Law on the Sectoral delimitation of rights to Polar possessions is considered.

Characterized by a change from a 1997 Arctic Legal policy of Russia, considered according to its National Interests fragmented the application of article 76 of the UNCLOS, in isolation from the applicable customary rules of International Law and the suggestions of scholars about the new legal qualification of the Arctic Ocean seabed (by the consideration of it as a "Common Heritage of Humanity"). 

The conclusion is made that it is necessary to comply with the customary legal rules in an integral set of applicable treaty and customary rules that make up the modern regime of the Arctic Ocean seabed and that unite the coastal Arctic states in solving the problem of delimitation of the Arctic shelf.
