Abstract

This article is a review of the scientific and encyclopedic publication of M.I. Kleandrov “The judicial corps of Russia: improving the mechanism of formation”.

The monograph deals with the problems of organizational and legal mechanism of selection of candidates for the positions of judges and giving them judicial powers. The need for a stereoscopic approach to the problem required an analysis of the development of both the domestic mechanism for the formation of the judiciary in the dynamics, and international and foreign regulation in this area

Examines the issues of the Institute a candidate for the position of judge, methods of evaluation of professionalism, medical and psycho-diagnostic survey of the property qualification, the mechanism of competitive selection, “prices” human error in the appointment of judges. Proposals on radical improvement of the procedure of selection of candidates for the positions of judges and granting them judicial powers are made and substantiated.

1 В условиях продолжающейся судебной реформы, укрепления гарантий судебной системы как одной из ветвей государственной власти особую роль приобретает исследование проблем повышения эффективности судебной защиты прав и законных интересов граждан и юридических лиц.
2 В этой связи весьма актуальным и интересным представляется очередной научный труд М.И. Клеандрова, посвященный исследованию проблем, связанных с формированием судейского корпуса в России, в частности, с выявлением недостатков организационно-правового механизма отбора кандидатов на должности судей и наделением их судейскими полномочиями.
3 Михаил Иванович Клеандров – судья Конституционного Суда РФ в отставке, главный научный сотрудник Института государства и права Российской академии наук, главный редактор журнала «Государство и право», член-корреспондент РАН, доктор юридических наук, профессор, заслуженный юрист РФ, заслуженный деятель науки РФ.
4 Степень разработанности темы исследования достаточно высокая, так как за многие годы научной и практической деятельности автор опубликовал около 60 монографий и книг, более 450 научных статей, посвященных зарождению, становлению и развитию института профессиональных судей в России.
5 В новой книге М.И. Клеандров рассматривает судебную систему как «сложно структурированную, с огромным числом прямых, диагональных и обратных связей, линейных, нелинейных и вторичных эффектов. Главной движущей силой в ней, многосоставным ядром является судья, человек, во всем многообразии проявлений его человеческих качеств, главное из которых в данном случае – быть СПРАВЕДЛИВЫМ» (с. 6). «Но ведь судьи в любом государстве, в том числе у нас, не с Марса прилетают», - восклицает ученый и добавляет: а совершенен ли вообще механизм формирования судейского корпуса в России? (с. 7).
6 Действительно, судейский корпус в нашей стране весьма внушительный, численность его по штату составляет более 30 тыс. человек1. Но при этом, как отмечает автор, судейских вакансий немало, и это - на фоне сокращения числа претендентов на судейские должности, а показатель 2017 г. стал самым низким за последние пять лет, хотя число вакансий не уменьшилось2. 1. 7 Стержень научной работы М.И. Клеандрова – совершенствование отечественного механизма формирования судейского корпуса, а следовательно, прежде всего законотворческая и организационная работа. Ученый вполне справедливо отмечает, что «главная миссия социальной науки заключается в проектировании будущего для общества, и юридическая наука как часть социальной здесь не исключение» (с. 9).
8 Вполне очевидно, что автор монографии, избрав целью выявление проблемы организационно-правового механизма отбора кандидатов на должности судей и наделения их судейскими полномочиями, предложил решить задачи, которые, по его мнению, позволят определить пути модернизации данного института судебной власти.
