Abstract

This article analyzes the fundamental changes in the domestic legislation, which on the initiative of the Supreme Court of the Russian Federation and under the motto of humanization of the criminal responsibility incurred in 2016–2017. Was proposed to decriminalize deliberate acts directed against life and health, despite the fact that the need for criminal-law protection last before no one questioned. The author comes to the conclusion that partial decriminalization of beatings and other violent acts opens a new stage of modern criminal policy. The article analyzes the declared grounds for decriminalization and the resulting conflicts of criminal and administrative processes, as well as the sanctions provided for in the updated law. The decrease in the level of protection of the constitutional right to personal inviolability is stated, the criminological, social and other consequences of the implemented innovation are shown.
