Abstract

The author analyses existing in the Russian and foreign literature concepts and classification of legal systems and legal families, notes their inaccuracies. The terms "legal system" and "law" are often used as similar, different social essence operating in the world of the three global legal systems is ignored. Offers new approaches, another synthesis and classification of legal systems and a new classification of legal families. Use methods of historical, logical, deductive, inductive, systematic-functional and comparative legal study, formational-civilizational approach. Along with the legal systems of individual states and traditional families are allocated on the basis of social essence three major legal systems in the modern world: Muslim system (applies to more than 7 billion people), semi-social liberal-capitalist system (with adjacent to it by many developing countries over 4.5 billion) and the totalitarian socialist system (more than 1.5 billion persons). Identifies the main characteristics and features of each global legal system. Families exist in the global system. On the basis of culturally-legal based approach within each of global systems at the same social entities on the basis of mainly informative signs (legal content) allocated legal families. In each system named after the families, identifies the main differences of families and provides examples of countries. Convergence of socially antagonistic systems going, but harmonization is not possible until you overcome antagonisms.
