Development of provisions of harmonizing the principles of conflict-law regulation of intellectual property rights to objects of industrial property

Abstract

Modern conflict-of-laws mechanisms of regulation of relations in the field of protection of industrial property rights are considered. The author analyzes the provisions of the harmonizing principles of conflict-of-law regulation of intellectual property developed by the world's leading research centers (the principles of ALI, CLIP, TRANSPARENCY, WASEDA, KOPILA). The features of the definition of the law applicable to the objects of industrial property are highlighted. The author, developing and generalizing the provisions of these principles, proposes a differentiated conflict-of-law approach to industrial property. The necessity of using the mechanism of splitting the intellectual Statute is established. It is proposed to apply the law of the state in respect of which protection is sought to determine the issues of protected objects of industrial property and the need to perform formalities related to the mandatory state registration of rights in respect of them. For all other matters of the intellectual Statute, the applicable law is the law of each state of registration. The author proposes to apply the law of the state of origin to the objects of industrial property subject to international registration (trademark, name of place of origin, geographical indication). With respect to unregistered objects of industrial property, the expediency of applying the law of the state in respect of which protection is sought is justified. In situations where the use of the object of industrial property or possible violations of the rights to the object occur simultaneously on the territory of several States (in cases of use of industrial property in the sale of goods on the Internet), it is proposed to apply the law of each state, the market of which is affected by the action of rights to objects of industrial property.
