Risk-based approach in labor law regulation as a new type of legal impact

Abstract

The article deals with the problems of transformation of legal impact methods in the conditions of the digital economy by the example of introduction of a risk-oriented legal model in the field of regulation of supervision and control over observance of labor legislation and management of OSH in the organization. The author considers the risk-oriented legal model as a dynamic, provided with legal and information technologies, a preventive way of legal influence, the purpose of which is to stimulate the activity of subjects of labor legal relations, increase their social responsibility. A key element of a risk-based legal model is the risk category. The thesis about the need for a specialized approach to the methodology for identifying and assessing the level of occupational risk is illustrated by the example of psychosocial risk.
