Abstract

The article is the description and tentative estimation of the attempts to assume the achievements of the whites, and to establish self-government/statehood, made by Five Civilized Tribes – Cherokee, Chickasaw, Choctaw, Creeks, and Seminoles – in the areas of their settlements within the States, from 1776 till 1830. The influence of certain events for relations between those tribes and the whites are examined: of the War for Independence; the adoption of the U.S. Constitution; of “the Indian Rebirth” due to activity of Tecumseh; the prevailing of certain political parties – Federalists, Democratic Republicans, and National Republicans – in federal and local politics. Certain outstanding chiefs, like Alexander McGillivray, John Ross, and others, tried to establish certain models of modus vivendi with Anglo-Saxons, and the difference between those models is also described. The author believes that the possibility to integrate the tribal communities – esp. of Cherokees, Chickasaw, Choctaw, less of Creeks and Seminoles – into political bodies of States actually existed. But the status of States before the Civil War was so high that certain States, esp. Georgia, caught Indian lands, encroaching guarantees given to Indians by the Federal power: for example, by President John Quincy Adams, and by Chief Justice John Marshall. This sort of “scissors” provoked regular conflicts between Indians and whites, and eventually prepared the Removal Act of May 28, 1830.

1 К концу Войны за независимость (1775–1783) США осуществили свой “первый бросок на Запад”: установили контроль над территорией между Аппалачами и рекой Миссисипи. На юге новые владения США соприкасались с испанскими. Американцы обнаружили, что значительная часть пограничной местности населена не совсем обычными индейцами. Они сохраняли у себя родовой строй и большие семьи с системой родства типа кроу, не отказывались от традиционной промысловой охоты, но жили сравнительно оседло и при обработке земли использовали те же орудия, что и белые. Некоторые из них владели плантациями, на которых трудились негры-рабы. В индейских поселениях жили многочисленные метисы, нередко внешне трудно отличимые от белых. И среди индейцев и метисов было немало грамотных и христиан. Ранее с такими народами – чироками – сталкивались только колонисты Джорджии.
2 Впоследствии, с 1876 г., за пятью индейскими племенами этого ареала – чикасо, чокто, чироками, криками и семинолами – закрепилось общее название Пять цивилизованных племен (Five Civilized Tribes). В колониальный период были известны четыре из них; этноним “семинолы” стал использоваться только в связи с 1-й Семинольской войной 1816–1818 гг. Язык чироков, переселившихся в Южную Каролину и Теннесси с севера (предположительно с Великих озер), относится к числу ирокезских; прочие четыре племени говорили на родственных друг другу языках маскогской группы.
3 Британские колониальные власти до 1776 г., а федеральная власть США и власти отдельных штатов – и позже придерживались по отношению к этим индейцам политики сегрегации в разных вариантах. Они либо организовывали резервации по месту обитания коренных народов, либо осуществляли их депортацию на новые территории. До 1871 г. существовала практика заключения с индейскими племенами договоров, по условиям которых от индейцев почти всегда требовали того, что обычно называется “отказом от земли”.
4 Уточним, чтó это было на самом деле. Бенджамин Горас Хиббард (Benjamin Horace Hibbard, 1870–1955), крупнейший специалист по истории земельного права США, для описания территориальных отношений предложил в качестве базового понятие “общественный домен” (public domain). Это все земли, когда-либо бывшие собственностью США как федерации, в т.ч. и те, что позже были переданы в собственность других юридических субъектов на основании американских законов (Hibbard 1924: 7). Провозглашение независимости США само по себе не означало формирования “общественного домена”: верховным собственником земли каждой колонии, в 1776 г. ставшей штатом, был штат. Девять из 13 штатов заявляли о своих правах на земли за Аллеганами. Представители Мэриленда – одного из четырех “безземельных” штатов – в Континентальном конгрессе1 15 октября 1777 г. предложили передать эти территории в собственность США. “Общественный домен” возник 19 февраля 1780 г., когда штат Нью-Йорк первым отказался в пользу США от своих прав на земли западнее Аппалачей. Джорджия сделала это последней из старых штатов – в 1802 г. 1. Континентальный конгресс – руководящий орган США в период с 1775 по 1789 г.. В 1789 г. вместо него был учрежден Конгресс США.
