Abstract

Although the global economic crisis of 2020 was caused by the spread of coronavirus, not the crisis situation in the United States, as in the case of the financial crisis of 2007-2009, the current state of affairs in this country is still of separate interest, as the state of the world's largest US economy has a significant impact on the economies of other countries, including Russia. Like any economic crisis, the crisis provoked by the pandemic was accompanied by the growing number of company bankruptcies. In the United States, this growth occurred within a few months after the COVID-19 pandemic outbreak, and the number of bankruptcies continues to grow despite government measures to contain it. Almost half of the about 2.9 trillion dollars in crisis relief funding was allocated to financial aid for companies experiencing difficulties and for protection of small businesses. Nevertheless, in 2020 the number of business bankruptcy filings was 32,506, a 43 % increase over 2019. The problems of companies, already existing at the time of the coronavirus emergence, and the weaknesses of the American bankruptcy system, declaring themselves much more strongly in the current conditions of the pandemic, are among the main factors influencing the situation with bankruptcies in the country. The Government cannot concentrate all its energies on support to business when a matter of the health and life of citizens comes first. Today, the US ranks first in the world in terms of the number of COVID-19 cases and deaths.

2 Статистические данные Административного управления судов Соединённых Штатов по заявлениям о признании банкротом начиная с 1980 г. [1] показывают, что больше всего заявлений, включая заявления бизнеса и потребителей, а именно 2078415, было зафиксировано в 2005 г. (см. табл. 1). Это единственный случай в истории банкротств в США, когда общее число заявлений превысило два миллиона. В этом же году отмечено наибольшее количество заявлений потребителей – 2039214, которое превысило число заявлений бизнеса в 52 раза. Число потребительских заявлений всегда превышало количество заявлений бизнеса, но разница никогда не была настолько существенной: от 4,4 раза в 1984 г. до 46,4 раз в 2003 г. В среднем потребительских заявлений было больше в 23 раза. Таким образом, в 2005 г. на долю бизнеса пришлось всего 39201 заявление, что является далеко не рекордным показателем, и, следовательно, отдельно взятое число заявлений о признании банкротом бизнеса или потребителя может отличатся от позиции общего числа заявлений в соответствующем году. Наибольшее число заявлений бизнеса пришлось на 1987 г. и составило 82 446 заявлений, тогда как общее число заявлений о банкротстве того года (577 999) почти в четыре раза меньше показателя 2005 г. (2 078 415).
3 Отметим, что наименьшее общее число заявлений о банкротстве, а именно 331 264, приходится на 1980 г. В 1984 г. было подано наименьшее количество потребительских заявлений – 284 517. Самое небольшое число заявлений от бизнеса о признании банкротом зафиксировано в 2006 г. – 19 695 заявлений.
4 Связь между экономическим кризисом и регистрацией банкротств также не всегда непосредственная. Количество соответствующих заявлений всегда растет, но не всегда существенно. Так, после пузыря доткомов в начале 2000-х годов число заявлений бизнеса выросло незначительно – с 37884 в 1999 г. до 40 099 в 2001 г. После мирового финансово кризиса 2007–2009 гг. это число увеличилось в два раза – с 28 322 в 2007 г. до 60 837 в 2009 г. (схожее соотношение наблюдается и в потребительских заявлениях); отдельно число коммерческих заявлений о признании банкротом увеличилось с 6245 в 2007 г. до 15 240 в 2009 г., то есть в два с половиной раза. Под коммерческими заявлениями понимаются заявления коммерческого бизнеса (коммерческих организаций), характеризующегося получением прибыли и уплатой с неё налогов. Коммерческий бизнес имеет акционеров и, если он достаточно большой, может быть зарегистрирован на фондовой бирже, продает товары и услуги другим предприятиям или потребителям. В свою очередь некоммерческий бизнес создает резервы и платит налоги за работников, принадлежит национальным или местным органам власти, органам власти штатов или компаниям с ответственностью участников в гарантированных ими пределах (company limited by guarantee). Некоммерческий бизнес также осуществляет продажу товаров и услуг, но не преследует извлечение прибыли в качестве основной цели своей деятельности.
