Abstract

The different features of regional location and territorial organization of gambling business in Ukraine are disclosed. The essence of gambling business is substantiated. Gambling has been determined as organization of games in casinos, gaming machine halls, computer simulators, bookmakers, interactive establishments, electronic casinos, etc. in order to win a prize. Gambling is an entrepreneurial activity that aims to generate revenue from the game through the organization, conduction and provision of gambling access for players. The features of world gambling market territorial organization are investigated. The distribution of profits by separate directions of gambling business is determined. There are: casinos, lotteries, slot machines, bookmaking, bingo, etc. The role of different countries and regions in development of gambling business is established. The dynamics of key gambling revenue indicators in different countries and regions are presented. The market share of electronic gambling as well as of gaming using the Internet resources is determined using general indicators of gambling development. The features of gambling in different number of world gambling centers are outlined. There are: the United States of America, Malta, Monaco, the United Kingdom, Gibraltar, India, Cambodia, China (Macau). The short-term forecasts of key analytical companies involved into monitoring the gambling market in the world are presented. The basic prospects of sectoral and territorial transformations in the structure of gambling business of different countries and regions are outlined. The peculiarities of the legislative regulation of regional development of gambling in Ukraine, its legalization, licensing, certification and territorial organization are revealed on the basis of world experience. The different territories of gambling priority development in Ukraine are localized. There are developed based on leading luxury and representative hotel chains, located in the biggest cities of Ukraine such as Kyiv, Lviv, Odesa, etc. These localizations are proposed by different scientists and practitioners involved into gambling and hospitality business. The features of the branch and the spatial structure of gambling priority development territories in Ukraine are explored. The modern forms of e-commerce in gambling are investigated. The different brand-new versions of extraterritorial and electronic-virtual forms of gambling business are defined. The usage of gambling mobile applications, “electronic casinos” and "floating casinos" in the Black Sea, cruise ships, etc. are substantiated. The financial, economic, and legal aspects of gambling business development in Ukraine are discovered. The different mechanisms of licensing, certification and legalization of gambling establishments in Ukraine based on decriminalization and state regulation of gambling businesses are proposed.

1 Ведение. В современном украинском обществе идут оживлённые дискуссии о механизмах и принципах организации и ведения игорного бизнеса и легализации азартных игр. Бурное и неконтролируемое развитие этого сегмента индустрии развлечений приходилось на середину 90-хх гг. прошлого века и сопровождалось существенным ростом социальной напряжённости в обществе, негативными явлениями, связанными с деятельностью криминальных группировок, мошенничеством и преступными действиями, направленными на незаконное обогащение при помощи ряда технологических, организационных и лицензионных махинаций вокруг игорного бизнеса. Исследование особенностей организации игорного бизнеса в разных странах и регионах мира, формирование мирового рынка игорного бизнеса, а также организация легальных, безопасных и законодательно регулируемых учреждений, оказывающих услуги по организации и ведению азартных игр, приобретают в наше время особую актуальность.
2 Целью исследования является анализ особенностей размещения и территориальной организации игорного бизнеса на Украине.
3 В число задач исследования входит установление сущности игорного бизнеса и азартных игр вообще, исследование особенностей территориальной организации игорного бизнеса в разных странах и регионах мира, особенностей формирования мирового рынка игорного бизнеса, раскрытие особенностей регионального развития и законодательного регулирования игорного бизнеса на Украине, его легализации, лицензирования, сертификации и территориальной организации, исследование территорий приоритетного развития заведений игорного бизнеса в Украине, их отраслевой и пространственной структуры, освещение экономико-правовых аспектов распространения экстерриториальных и электронно-виртуальных форм азартных игр, а также разработка механизмов лицензирования, сертификации и легализации заведений игорного бизнеса на Украине на основе их декриминализации и государственного регулирования.
4 Степень изученности проблемы и новизна исследования. Проблемы легального и прозрачного функционирования заведений игорного бизнеса интересуют многих авторов. Так, собственно сама природа популярности азартных игр была раскрыта в фундаментальных философских работах Йогана Хёйзинга [2], а психология игрока в азартные игры — в литературных романах Ф. М. Достоевского [5]. В настоящее время опубликована обстоятельная научная работа С. Г. Осыки [11], посвящённая роли государства в организации и ведении азартных игр. Кроме того, современные финансовые, экономические, правовые и управленческие аспекты развития игорного бизнеса раскрываются в работах А. Германовой [3], Д. Карташова [7], Н. Неправской [9] и др. Однако, комплексного научно анализа особенностей регионального размещения и территориальной организации игорного бизнеса на Украине в свете принятия закона о легализации азартных игр и весомого общественного заказа на их проведение ещё детально не проводилось.
