Право на установление истины в контексте правосудия переходного периода: опыт стран Латинской Америки

Аннотация

Понятие права на установление истины, или права на истину, появилось в международной юриспруденции относительно недавно — в 1980—1990-е годы в контексте постконфликтных ситуаций и демократического транзита во многих государствах мира. Существенный вклад в развитие и концептуализацию данного права внесли страны Латинской Америки, так как именно там право на истину рассматривалось как составная часть политических, юридических и общественных механизмов, созданных с целью предотвратить насильственные исчезновения людей. В данной статье прослеживается эволюция данного права в международных и региональных соглашениях и в «мягком праве», а затем в решениях Межамериканского суда по правам человека. Будет проанализирован пример Аргентины, являющейся по ряду критериев уникальной страной региона: там были основаны различные институты правосудия переходного периода, проведены громкие судебные разбирательства. Несмотря на то, что объемы и содержание концепции права на истину до сих пор оспариваются в научном и политическом сообществах, можно утверждать, что, по крайней мере, в области борьбы с насильственными исчезновениями людей к настоящему времени сложились судебная практика и нормативно-правовая база, позволяющие считать это право обязательным.
