Animals in reflection of civil law regulation and jurisprudence: from reality to legal personality

Abstract

The author focuses on the problem of building a new paradigm of human-animal relations, creating for them an adequate civil-legal status, taking into account their importance and role in the life of modern society. The author states that animals are a gift of nature, a benefit, a necessary condition for the quality of life. Thus the operating civil legislation of the Russian Federation proceeds from a recognition for animals the strongly pronounced status of the thing, recognizing them objects of the property right. Domestic judicial practice takes a similar position. Taking into consideration achievements of world civilistic science and precedents of courts which have recognized special legal status of animals as an individual, the author leads to the conclusion that Russian legislator as well as courts of law should think about the necessity of changing civil status of animals, recognizing them as reasonable living beings, worthy not only creating favorable living conditions, but also respect from the human side. The author formulates specific proposals for improving the domestic civil legislation defining the legal status of animals.
