State legal regime as an element of the form of the democratic state

Abstract

This article notes that, despite the fact that the political (state, state-legal) regime has been in the field of view of domestic science for a long time, there is still no unity of understanding of this phenomenon. Emphasizing that the latter occupies a leading place in the system of elements of the form of the state, attention is drawn to the fact that it is he who individualizes the form of national statehood, determines its role and socio-political significance in the state-legal mechanism, characterizes the dynamic, functional side of the state: how it acts, dominates the kind of political atmosphere it creates in society. Analyzing various scientific approaches to the concept of this element of the form of the state (political-systemic, sociological, integrative-differentiated), attention is drawn to the fact that in domestic jurisprudence the most widespread formal legal, focusing on the procedural characteristics of the implementation of state power, i.e., methods and the methods by which this power is exercised. The author is convinced of the inadmissibility of confusion of the concepts of “political regime”, “state regime”, “state legal regime”. It is the latter that should be used as an element of the form of a democratic state, except for the form of government and the form of state-territorial structure
