Abstract

The article examines the state of the judicial system of the Russian Orthodox Church in accordance with current legal acts. The author examines the compatibility of the fundamental principles of the Church's existence with the mechanism of functioning of judicial bodies. The definition of ecclesiastical courts is specified ex negativo by categorical differentiation of the essence and competence of state courts, as well as the confessional "court of conscience". The current legislation of the ROC in relation to the judicial power is being investigated on the basis of the ROC Charter and the Regulations on the ROC ecclesiastical court. The main principles, goals and objectives of Church justice, the hierarchy of legal acts and judicial authorities, the rights and obligations of participants in judicial processes, the entry into legal force of decisions of Church courts and the procedure for appealing them to higher instances are announced. Particular attention is paid to current problems of Church law, in particular the principle of delegating judicial powers to lower-level bodies of Church justice, the question of whether the Primate of the Russian Orthodox Church has judicial powers, textual contradictions in the Charter and Regulations on the Church court and how to resolve them, as well as access to various levels of judicial power and the specifics of legal proceedings. The author outlines a range of issues of Church law that hinder the improvement of the quality and effectiveness of Church justice and therefore await prompt competent resolution.
