Abstract

The authors analyze article 27 of the Federal Law No. 323-FL from November 21, 2011 “On the Basics of Protecting Citizens' Health in the Russian Federation”, which establishes the duties of citizens in the field of health protection. The general duty of citizens to “take care of their health”, formulated in part 1 of article 27, implies the requirement addressed to all and everybody to perform actions that benefit health and refrain from actions that bring harm to it. The authors emphasize the legal and actual unclarity and other features of this duty and draw attention to the absence of the elements of «the legal duty» concept highlighted in the theory of law. However, parts 2 and 3 of article 27 of Federal Law No. 323-FL leave no doubts about the requirements for the behavior of citizens and are supported by legal responsibility for their failure to comply. This is illustrated by the provisions of the law related to general rules of Part 2 of article 27, and in particular, federal and regional legal acts adopted in connection with the spread of recent coronavirus infection (COVID-19) in the territory of the Russian Federation. The authors indicate the features that distinguish the general norm-declaration of a binding nature from the legal duty in strong sense, which can be fixed in the law.
