Abstract

The article deals with the general theories of justice formulated in different epochs within the framework of the formation of a worldview attitude to social activity. According to the results of the analysis, it is established that the key features of the fair construction of social relations were described in the period of antiquity. Later, the theory of justice was humanized, and research was conducted on the moral requirements for fair behavior. In the Western philosophical literature, egalitarian views on the theory of justice prevail, as a result of which there is a restoration of certain ideas of the utilitarian sense. In Russia, despite the positions of supporters of unlimited individual freedoms, a special patriotic view of the idea of a fair state system prevails. In these conditions, the problem of justice in court proceedings should be solved comprehensively, taking into account the established traditions. From the point of view of the theory of procedural justice, it is necessary to fine-tune the application of certain principles and institutions of criminal procedure law. The formulation of a particular theory of ensuring the fairness of criminal procedure activities should take into account the need to create conditions not only for assigning a fair punishment to the guilty person established on the basis of the evidence obtained, but also to protect the interests of any person who to some extent finds himself in the sphere of interests of authorized law enforcement agencies. At the same time, the fairness of criminal proceedings consists in the presence of the reaction of the state in the person of special bodies to the committed, committed or prepared socially dangerous act.
