Abstract

The article is devoted to constitutional problems of the right of the peoples of the Russian Federation (on the example of the Republic of Karelia) to self-determination. A general description of this right is given. In particular, the constitutional and international legal foundations of the right of peoples to self-determination, the peculiarities of its implementation in Russia taking into account the status of ethnic communities are revealed. It is demonstrated that recognition of this right implies guaranteeing certain collective and individual rights to its subjects. The legislation and the practice of the implementation of this law in Karelia are analyzed. In this context, provisions of Karelian Constitution are systematized to confirm the national character of the Karelian statehood, the need for their concretization and development is substantiated. The required development refers to the emergence of the named statehood, legal identification of ethnic groups, the creation of national municipalities (with the explanation that they make sense if provided with special authority), the participation of ethnic communities in decision-making affecting their rights and interests (from the standpoint of improvements of existing forms and procedures in this area), the protection of cultural rights - the rights to the native language and cultural values. The Karelian experience in ensuring the right of ethnic communities to self-determination in its various manifestations is compared with the solution of similar issues in other constituent entities of the Russian Federation.
