Abstract

The article deals with the alternatives to prosecution in the French criminal procedure, as well as their purposes and the conditions for the recourse to such alternatives. The alternatives to prosecution in France include measures, prescribing to comply with certain legal obligations, mediation, penal settlement (“composition pénale”) and plea agreement (“transaction pénale”). The authors pay particular attention to the advantages and disadvantages of the alternatives to criminal prosecution. In light of the achievements of the French legislation, the perspectives of the improvement of the Russian legislation are assessed, taken into account the mechanisms that already exist in Russian law, such as reconciliation of the parties and the pre-trial cooperation agreement.
