Abstract

The discussion of the relation between theory of law and Philosophy of Law moves from the phase of bringing rational arguments and constructive dialogue in the phase of mutual accusations of the incompetence of the representatives of the theory of law, Philosophy of Law, and representatives of the Philosophy of Law – theory of law. The "revolutionary" consciousness of the conflicting parties does not lead to paradigm shifts, since it rests on the conceptual apparatus that has exhausted its heuristic potential in this direction. To give a polemic about the relationship between the theory of law and the Philosophy of Law impulse, it is proposed to use the conceptual foundations of the theory of metaphenomenes in law. She clarifies the “cross-border” conceptual apparatus, optimizes the interaction of linguistic and metalanguage means. It is proposed to consider their functional characteristics as a metalanguage tool to distinguish between the general theory of law and the Philosophy of Law. The conclusion is made that the general functional matrix of the theory of law and Philosophy of Law is complementary.
