Abstract

According to the legal definition laid down in the article of the Criminal Procedural Code of the Republic of Azerbaijan, dedicated to the basic concepts of criminal procedural legislation, the prosecutor - is a person who, within the limits of his authority in accordance with the ruling established for in the Criminal Procedural Code, provides procedural management for the preliminary investigation of a criminal case or supports public or public-private accusation in the court as a public prosecutor. Nevertheless, a systematic analysis of the rules of the Criminal Procedural Code demonstrates that the functions of the Prosecutor's Office, including the Military Prosecutor's Office, are not restricted only to procedural management and the defense of public prosecution. In the article, the author attempted to analyze some other basic functions of the military prosecutor, and also generally expressed his attitude for the establishment of the military prosecutor’s office as a specialized authority
